Relating to Bagdurbar Protection-Decided Case
Decision Number: 10889
Decision on 2075
Petitioner and Respondent: Advocate Prakash Mani Sharma and others on behalf of Pro Public Vs. Mayor, Bidya Sundar Shakya, Kathmandu Metropolitan City and others.
The Court held that Historical and archaeological heritages are connected to a nation's past and are passed down from one generation to the next, carrying with them a deep emotional connection of the people. These heritages are not limited to an individual or an institution, but are related to groups, communities, regions, and the state itself. Therefore, every nation must inform its future generations about its historical, archaeological, and cultural heritage. Claiming that heritages of archaeological or cultural importance are “too narrow” or making other such unacceptable arguments to abandon preservation efforts, and instead letting them decay or demolishing them for new construction, cannot be justified from any perspective. No one can be exempt from the responsibility of preserving the legacy of our ancestors for future generations. This is a matter of collective national responsibility.
